TERMS AND CONDITIONS
By accessing or using this website and/or purchasing any products from KHATAM®,you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.
DEFINITIONS:
1. “KHATAM®”, “we”, “us”, or “our” refers to Khatam Festive Apparel Sdn. Bhd., including its brands, divisions, boutiques, affiliates, and authorized representatives.
2. “Customer”, “you”, or “your” refers to any individual or entity who accesses the website or purchases Products from KHATAM®.
3. “Products” refers to all goods, merchandise, or items offered by KHATAM® for purchase, whether acquired online or in-store.
4. “Order” refers to a confirmed purchase made by a Customer for Products offered by KHATAM®.
5. “Store Credit” refers to a non transferable credit issued by KHATAM® in lieu of a cash refund, and is subject to KHATAM®’s Terms & Conditions.
6. “Boutique” refers to any physical retail location operated or authorised by KHATAM®.
7. “Terms & Conditions” refers to this document, including any amendments or updates made by KHATAM®.
1. PAYMENT TERMS
1.1 Accepted Payment Methods
1. iPay88 Malaysia: A secure and reliable online payment gateway for processing online transactions.
2. Credit/Debit Cards: Major cards, including Visa and Mastercard, are accepted.
3. ShopBack: Payments made via ShopBack may qualify for cashback, in accordance with ShopBack’s terms and conditions.
4. Atome PayLater: Allows Customers to split payment into three (3) interest-free installments, subject to Atome’s approval and terms.
5. Payment Authorization: All payments are subject to authorization and approval by the respective payment provider. KHATAM® is not responsible for any failed or declined transactions due to issues with the payment provider, insufficient funds, or incorrect payment information.
6. Third-Party Terms: Customers agree to comply with the terms and conditions of third-party payment providers. KHATAM® is not liable for any disputes or issues arising directly from these providers.
1.2 Order Confirmation
1. Orders cannot be changed, edited, or cancelled once submitted.
2. Customers are responsible for reviewing all order details, including items, quantities, sizes, and shipping information, before completing payment.
3. Submission of an Order constitutes an offer by the Customer to purchase Products in accordance with these Terms & Conditions.
4. KHATAM® reserves the right to accept or reject any Order due to stock unavailability.
5. After an Order is successfully submitted, the Customer will receive an Order confirmation email, which serves for record purposes and indicates that the Order has been received for processing.
6. KHATAM® is not responsible for any errors in Orders submitted by the Customer, including wrong sizes, quantities, or delivery details.
1.3 Processing Time
1. Orders are typically processed internally within 2–5 business days from the date of Order confirmation.
2. Processing time refers solely to internal order handling and preparation and does not include delivery or courier transit time.
3. Once an Order has been processed and handed over to the courier, a tracking number will be provided via email within 48–72 hours.
4. The tracking number enables Customers to monitor the shipment status directly with the courier.
5. KHATAM® is not responsible for delays caused by factors outside its control, including courier delays, customs clearance, or public holidays.
6. Customers are responsible for providing accurate shipping information; any delays or misdeliveries resulting from incorrect information are the
Customer’s responsibility.
2. SHIPPING & DELIVERY
2.1 Local Shipping (Malaysia)
1. Peninsular Malaysia: Estimated delivery within 2–3 business days.
2. Sabah/Sarawak: Estimated delivery within 3–5 business days.
3. All delivery timeframes stated above refer to courier transit time only and commence after the Order has been processed and dispatched.
4. Processing time is not included in delivery estimates.
5. KHATAM® is not responsible for delays, damages, or losses incurred during delivery.
2.2 International Shipping
1. Singapore: Estimated delivery within 4–7 business days.
2. Worldwide: Estimated delivery within 5–10 business days.
3. All delivery timeframes stated above refer to courier transit time only and
commence after the Order has been processed and dispatched.
4. Processing time is not included in delivery estimates.
5. International Customers are responsible for any customs duties, taxes, or import fees.
6. KHATAM® is not liable for delays, damages, or losses during international shipping.
2.3 Local Pick-Up
1. Pick-up is only available after the Order has been fully processed and upon receipt of a “Ready for Pick-Up” notification from KHATAM®.
2. Collection hours are 11.00AM – 4.30PM on business days, subject to change without prior notice.
3. Customers must bring the Order confirmation and a valid form of identification when collecting their items.
4. Pick-up must be made at the location specified in the Order confirmation email.
5. KHATAM® is not responsible for any delays or issues if the Customer fails to collect the Order within a reasonable time.
3. EXCHANGE POLICY
3.1 Exchange Channels
1. Online Purchases
1.1.2 Online orders must be returned to KHATAM® HQ for exchange.
2.1.2 Exchanges for online purchases cannot be processed at KHATAM® boutiques.
2. In-Store Purchases
1.1.2 Products purchased in-store may be exchanged at any KHATAM® boutique or the KHATAM® Experience outlet.
3.2 Exchange Eligibility Period
1. Exchanges are allowed within seven (7) days from the date of purchase.
2. Only normal-priced items are eligible.
3. Customers must provide the original receipt, with all original tags and accessories intact.
3.3 Exchange Conditions
1. Items must be unworn, unwashed, and in original condition with tags attached.
2. Exchanges are limited to:
1.1.2 Size changes, or
2.1.2 Manufacturing defects confirmed by KHATAM®.
3. Exchanges are for the same item only.
4. If the same item is unavailable:
1.1.2 Customers may select an alternative item and pay the price
difference if the replacement item is higher priced.
2.1.2 No cash refund is provided if the replacement item is lower priced.
3.4 Exchange Limitations
1. One exchange per receipt is allowed.
2. Strictly no exchange for:
1.1.2 Stock clearance or markdown items
2.1.2 Altered items
3.1.2 Items returned beyond seven (7) days from purchase
3. Exchanges are applicable for purchases made in Malaysia only.
4. KHATAM® reserves the right to refuse any exchange if conditions are not met or if the request is deemed unreasonable.
4. REFUND POLICY
1. Refunds are only permitted for items that are incorrectly supplied or confirmed to have manufacturing defects attributable to KHATAM®.
2. Exchanges will be provided for the same item, subject to stock availability.
3. If the item is out of stock, a Store Credit will be issued in accordance with KHATAM®’s Terms & Conditions.
4. No cash refunds will be provided under any circumstances.
5. KHATAM® reserves the right to decline any refund request that does not comply with these Terms & Conditions.
6. Customers are responsible for returning items securely; KHATAM® is not liable for items lost or damaged during return transit.
7. All items returned for refund or exchange are subject to inspection by KHATAM® staff, and requests may be refused if the item does not meet eligibility or condition requirements.
8. Refunds and Store Credit issuance are subject to verification and approval by KHATAM®.
5. INTELLECTUAL PROPERTY
1. All content on this website, including but not limited to images, designs, text, graphics, and media, is the property of KHATAM® unless otherwise credited.
2. Unauthorized reproduction, distribution, modification, or commercial use of any content is strictly prohibited without KHATAM®’s prior written consent.
3. Any use of KHATAM®’s intellectual property must comply with applicable laws and these Terms & Conditions.
4. KHATAM® reserves the right to take legal action against any infringement of its intellectual property rights.
6. LIABILITY
1. KHATAM® is not responsible for any losses, damages, or costs arising from the use of this website or from the purchase, handling, or use of any Products. This includes, without limitation, direct, indirect, incidental, or consequential damages.
2. KHATAM® shall not be held liable for shipping delays, customs issues, or damage incurred during delivery.
3. Customers assume full responsibility and risk for the use, handling, and transportation of Products once purchased.
4. By purchasing or using KHATAM® Products, Customers acknowledge that they do so at their own risk, and KHATAM® is not liable for any issues arising from improper use or handling.
7. GOVERNING LAW
1. These Terms & Conditions shall be governed by and construed in accordance with the laws of Malaysia.
8. AMENDMENTS
1. KHATAM® reserves the right to modify, update, or amend these Terms & Conditions at any time without prior notice.
2. Any changes will be published on the website and will take effect immediately upon posting.
3. Customers are responsible for reviewing the Terms & Conditions periodically to stay informed of any updates.
4. Continued use of the website or purchase of Products after any changes constitutes acceptance of the revised Terms & Conditions.
9. PRIVACY & PERSONAL DATA
1. KHATAM® collects, processes, and stores Customer personal data in accordance with the Personal Data Protection Act 2010 (PDPA) of Malaysia and other applicable data protection laws.
2. Personal data is collected solely for legitimate purposes, including but not limited to:
3.1 Processing and fulfilling Orders.
3.2 Communicating with Customers regarding Orders, promotions, services,
or other information (with consent where required).
3.3 Improving KHATAM®’s products, services, and overall customer experience.
3. KHATAM® will not sell, rent, or share personal information with third parties without prior consent, except where required or permitted by law.
4. KHATAM® implements reasonable technical and organisational measures to protect Customer data from unauthorised access, disclosure, or misuse.
5. By providing personal data, Customers consent to KHATAM®’s collection, processing, and storage of such data in accordance with this policy and applicable laws.
10. PRODUCT AVAILABILITY & DESCRIPTION
1. Product images, descriptions, and specifications are provided for reference purposes only and may differ slightly from the actual product.
2. Products are subject to availability, and KHATAM® reserves the right to limit quantities or refuse Orders at its sole discretion.
3. KHATAM® is not liable for any discrepancies between product images or descriptions and the actual product.
11. PROMOTIONS & OFFERS
1. All promotions, discounts, or special offers are subject to KHATAM®’s Terms & Conditions and may be modified, suspended, or withdrawn at KHATAM®’s sole discretion without prior notice.
2. Promotions or offers cannot be exchanged for cash or combined with other promotions, unless explicitly stated by KHATAM®.
3. KHATAM® reserves the right to verify eligibility for any promotion or offer and to decline or revoke any promotion in case of misuse or violation of Terms & Conditions.
12. LIMITATION OF LIABILITY FOR THIRD PARTIES
1. KHATAM® is not responsible for any loss, delay, or damage caused by third-party service providers, including payment processors and couriers.
13. FORCE MAJEURE
1. KHATAM® shall not be held liable for any failure or delay in fulfilling its obligations under these Terms & Conditions due to events beyond its reasonable control,
including but not limited to natural disasters, strikes, pandemics, government actions, or technical failures.
2. In the event of a Force Majeure, KHATAM® will endeavour to resume its obligations as soon as reasonably possible.
14. SEVERABILITY
1. If any provision of these Terms & Conditions is found to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.
2. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision of these Terms & Conditions.
